Ommnio makes available to you the information regarding your personal data processing, as set forth by the pertinent regulations: REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 (GDPR.)

Applicability of this Privacy Policy

This Privacy Policy applies to the Ommnio platform and tools, including Ommnio’s associated mobile and desktop applications (jointly referred to as the “Services”) as well as other interactions (e.g., customer service inquiries, user conferences and the like) which may be provided by Ommnio. If you do not agree with the terms and conditions, do not access or use the Services, Websites or any other feature of Ommnio activity.

This Privacy Policy is not applicable to any third party application or software that may integrate with the Services through the Ommnio platform (“Third Party Services”) or any other third party product, service or activity.

Likewise, access and use of the Services are governed by the General Terms and Conditions of Use and by an independent agreement (the “Agreement with customer”), which includes the processing of any message, file or other content sent through accounts and communication channels (jointly referred to as “Customer Data”.)

Customer (e.g. your employer or another similar entity/organization) entered into the Customer Agreement with Ommnio, granting access control to Ommnio services (Workspace with communication channels, messages, user registration and cancellation and the like) and to all the customer and associated users data.

If you have any doubt regarding the privacy practices or regarding the relevant specific setting up, please, contact the Customer the Workspace of which you are using. If you have an account, you can check to obtain contact information of the owners and administrators of your Workspace If you have received an invitation to join a Workspace, but have not yet created an account, you should request the assistance of the Customer who sent the invitation.

To the extent that the Information is associated with an identified or identifiable natural person and is protected as personal data pursuant to the applicable data protection law, we shall refer to the information in this Privacy Policy as “Personal Data”.

Ommnio is responsible for your personal data processing. In the present privacy policy, information is provided on the use that the Entity shall make of your personal data.

Description of the information contained in the privacy policy
In this privacy policy you will find the data processing performed by the Entity:

– The purposes of your personal data processing, that is to say, the reasons why the Entity deals with your personal data.
– The legal bases allowing the processing of your data by the Entity for each of the purposes indicated.
– The possible disclosure of your data to third parties, as well as the reasons for the disclosure thereof. For the purposes hereof, we inform you that we do not assign your personal data to third parties unless there is a legal obligation or unless you expressly give consent. On the other hand, those of the Entity responsible for processing may access your personal data, that is to say, the service providers requiring access to your personal data to develop the functions thereof. Service providers accessing your personal data, in general, are involved in information and technology systems areas. The following table shall show, where appropriate, other areas in which other possible providers of services to the Entity are involved and which may be required to access your personal data.
– We inform you that you can request more detailed information regarding the recipients of your data by sending an email to the address privacy@ommnio.com indicating the specific processing of the recipients you would like information about.
– The existence of potential international data transfers.
– The term of conservation of the data you provide us. Likewise, we inform you that your data shall remain blocked to meet judicial, administrative or tax claims, during the periods set forth by the applicable legislation.

1. INFORMATION MANAGEMENT THROUGH THE OMMNIO PLATFORM
Processing purposes
We process the information you provide with the purpose of providing access to a corporate communication channel of your employer or organization.

Legal Basis
The legal basis to process your information is your consent to this privacy policy and to Ommnio terms and conditions of use accepted by you at the time of registering in the platform.

Recipients
The data shall not be assigned to third parties except in cases where there is a legal obligation or is necessary to comply with the purposes agreed upon with our Customer, your employer or organization.

Transfers
There shall be no international transfers of your data based on this processing

Term of Conservation
As long as you do not proceed to cancel the service and, once suspended, for a period of 6 years to comply with possible legal requirements or claims.

2. ANALYTICAL AND STATISTICAL USE
Processing Purposes

We process the information generated with your use of the tool to analyze the aggregate and anonymized behavior of users for the development of Ommnio services and products

Legal Basis
The legal basis to process your information is your consent to this privacy policy and to Ommnio terms and conditions of use accepted by you at the time of registering in the platform.

Recipients
The data is anonymized and assigned to Google Ireland Limited based in the UE, only for the purpose of using the statistical analysis tools thereof.

Transfers
The data shall be stored in the UE.

Term of Conservation
As long as you do not proceed to cancel the service and, once suspended, for a period of 6 years to comply with possible legal requirements or claims.

3. PROVISION OF SERVICE
Processing Purposes
We use third-party technology (Amazon Web Services, Firebase, of Google Ireland Limited, Messente Communications Ltd. and Twilio Ireland Ltd.) to be able to provide instant messaging service.

Legal Basis
The legal basis to process your information is your consent to this privacy policy and to Ommnio terms and conditions of use accepted by you at the time of registering in the platform.

Recipients
Data is stored on Amazon Web Services in Ireland. Data is assigned to Firebase, Google Ireland Limited., based in the UE, only for the purposes of providing instant messaging service.Only for the purposes of validating the phone number, we use the Messente Communications Ltd. and Twilio Ireland Limited  as SMS sending platforms, based in the UE.

Transfers
Commonly used data service (channels, users, messages and the like) shall be stored in Ireland.
The validation data of the phone number via SMS shall be stored in Estonia or Ireland, members of the EU.

For what purposes do we process your personal data?
– To provide, update, maintain and protect our Services. This includes the use of the information to provide the Services pursuant to an Agreement with the customer, organizer; to prevent or deal with service errors, technical or safety problems; to analyze and control use, trends and other activities; or at the request of an authorized User.
– Pursuant to the regulatory framework in force.
– To contact you in response to requests, comments and questions.
– To develop and provide search tools and additional functions. Ommnio tries to make Services as useful as possible for workspaces and authorized users. For example, we can improve search functionality by using information to help determine and classify the relevance of contents, channels or specialization of information; to suggest services based on historical use and predictive models; to customize Services experience; or to create new products and productivity features.
To send emails and other Communications. We can send emails, messages and other types of communication regarding services, technical issues or administrative matters. Likewise, we can contact you to report changes in our Services, our Service offers and to send important notifications regarding the Service, such as security and fraud notifications. The above mentioned communications are deemed part of the Services and cannot be waived.
– Likewise, we sometimes send promotional electronic communications about Ommnio. They are marketing messages, so you can choose whether you want to receive them or not.
In case of users with administrator profile – For invoicing, account management and other administrative matters. Ommnio may need to contact you for invoicing, account management and other similar reasons and we use account data to manage accounts and to monitor invoicing and payments.
– To investigate and help prevent abuse and security problems.

Which is the legal basis for processing personal data?
To process personal data of the User, the legal basis is the consent to the privacy policy and to Ommnio terms and conditions of use. Likewise, remember that you also accept the privacy policy of the Customer, Organizer, and in that case Ommnio acts as a mere provider of Services.

In certain cases, such as fraud prevention and for security reasons, a legitimate interest in data processing shall be considered.

Age limitations
To the extent prohibited by the applicable law, Ommnio does not allow the use of our Services by any person under 16 years of age. If you are aware that any person under the age of 16 has provided us personal information contrary to what is legally set forth, please contact us and we will take the necessary steps to delete the above mentioned information.

Which are your rights when you provide us with your data?
Pursuant to the data protection regulations in force, you can exercise different rights.

– You can request access to your data and obtain a copy thereof.
– You can ask rectification and / or deletion thereof in some cases.
– You can object to the processing of your personal data for some specific purposes, for example, the preparation of personalized profiles.
– You can request us to limit the processing of your data.
– You can request the portability of the data you have provided.
– At all times, if you have given consent to be sent commercial communications, you have the right to revoke the above mentioned consent.

User can exercise the rights regarding data processing regulations. For this purpose, you may send an Ommnio letter to the following domicile: Sant Francesc, 4 Cerdanyola del Vallès 08290 Barcelona or an email to privacy@ommnio.com indicating the right you want to exercise. The identity of the applicant should be proven.

Likewise, we inform you that the user has the right to file a claim before the competent control authority (Spanish Data Protection Agency) if the user considers any type of breach has occurred in relation to the processing of the personal data thereof.

In case the limitation of the processing of your data is requested, we shall only keep your data to exercise or defend claims and in cases of objection the data shall no longer be processed, except due to compelling legitimate reasons or to exercise or defend possible claims.
