1. Legal Information and Acceptance of Terms
These Terms of Use govern the access to and use of the services provided by The Ommnio Communications, S.L. (hereinafter, “Ommnio”). Access to and/or use of the services implies the full and unconditional acceptance of the terms of use published by Ommnio at the time of access and/or use.


Ommnio is a communication platform for frontline employees that offers the following services:

  • Read-only chats for mass communication to users
  • Group or direct/individual chats for team coordination
  • Documents with acknowledgment of receipt
  • OmmnioSign, advanced digital signature of documents
  • Automated individual document distribution (payslips, certificates, etc.)
  • Document Manager
  • Time tracking
  • Forms and surveys
  • Chatbots
  • Whistleblowing channel for the collection of anonymous reports

1.1. OmmnioSign
OmmnioSign is an electronic document signing service that allows users to request, manage, and formalize the signing of documents in electronic format through the Ommnio platform.
The service integrates document management functionalities that allow the submission of documents for signature, tracking the status of each signature request, storing signed documents in the cloud, and sending reminders to signers who have not yet completed the signing process.
The signatures generated through OmmnioSign constitute advanced electronic signatures, as defined by Regulation (EU) No 910/2014 (eIDAS). Said signatures are linked to the signatory, allow their identification, and are generated using technical mechanisms that guarantee the integrity of the signed document and the detection of any subsequent modification.
OmmnioSign is provided in accordance with what is described in the Service Practice Statement for OmmnioSign, available here, which establishes the technical and organizational conditions applicable to the provision of the service and to the generation and management of advanced electronic signatures.
The service is provided in accordance with the provisions of Regulation (EU) No 910/2014, and its subsequent amendments, including Regulation (EU) 2024/1183, regarding electronic identification and trust services for electronic transactions in the internal market. OmmnioSign constitutes a non-qualified trust service, meaning that the electronic signatures generated through this service are not considered qualified electronic signatures within the meaning of said regulation.
Ommnio keeps activity records and electronic evidence associated with signature operations carried out through the service for a period of 10 years, to guarantee the traceability of the signing process and compliance with applicable legal and contractual obligations.
Third parties who rely on a signature generated through the service must verify the validity and integrity of the signed document. Documents signed through OmmnioSign incorporate the electronic signature in PAdES-LTA format directly in the PDF file, allowing verification through any compatible PDF reader, such as Adobe Acrobat Reader, which will automatically display the validity status of the signature, as well as through European validation tools compliant with the eIDAS regulation.
In the event of a security breach affecting the OmmnioSign service or the integrity of the electronic signatures generated, Ommnio will notify the competent supervisory body within a maximum period of 24 hours, in accordance with the provisions of Article 19.2 of Regulation (EU) No 910/2014. Furthermore, where such a breach may adversely affect users or the reliability of the signatures made, Ommnio will inform those affected without undue delay, indicating the nature of the incident and the measures adopted or planned to mitigate its effects.
The use of the OmmnioSign service involves the processing of personal data of the signatory necessary for the generation of the electronic signature and the creation of associated evidence, including identification data, authentication data, IP address, timestamp, and data from the device used. Such processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and the Ommnio Privacy Policy. 2. Terms of Use
The use of Ommnio is completely voluntary and is under the responsibility of each user.
The user agrees to use the Platform in a diligent, correct, and lawful manner and, in particular, commits to not engage in the following behaviors, by way of illustration and not limitation:
a) use Ommnio for a purpose that is considered illegal, immoral, or contrary to generally accepted practices or public order;
b) transmit or disseminate information, data, content, messages, graphics, drawings, sound and/or images, photographs, recordings, software and, in general, any material that is obscene, offensive, vulgar, or that may induce criminal actions, slander, defamation, any type of violence or, in general, any action contrary to the law, moral rights, or generally accepted good practices or public order;
c) reproduce, copy, or distribute the content, or allow public access to it through any form of public communication, or transform or modify it, unless done with the permission of the copyright holder or holder of the corresponding rights;
d) infringe intellectual or industrial property rights belonging to third parties or Ommnio;
e) use the services and content in a manner that could weaken or overload the operation of Ommnio;
f) carry out fraudulent transactions or transactions that may facilitate illegal or fraudulent conduct of any kind; and,
g) use the content and services and, in particular, information of any kind for advertising purposes and, in particular, for sending advertising, communications for direct sales purposes, or for any other commercial purpose without the authorization of the recipient and Ommnio.
The user authorizes their telecommunications provider to use or provide information about their account and their device, if available, to Ommnio or its service provider during the term of the business relationship, solely to help identify the user or their device and to prevent fraud. Users who use the OmmnioSign service commit to:
(i) properly safeguard the devices and authentication credentials used for electronic signatures, including biometric means (WebAuthn) and verification codes (OTP) received via SMS;
(ii) not share or transfer their signing credentials to third parties or allow another person to sign on their behalf using their account;
(iii) immediately notify Ommnio, at hello@ommnio.com, of any unauthorized use or suspected compromise of their signing credentials;
and (iv) guarantee the truthfulness of the identity data provided for the signing process. Failure to comply with these obligations shall release Ommnio from any liability arising from the improper use of the signing service.


The User shall be liable for damages of any kind that Ommnio may suffer directly or indirectly as a result of any breach of these Terms of Use and applicable regulations.

3. Responsibility in the Use of Ommnio
The User declares to be the legitimate holder of the intellectual and industrial property rights or to be authorized for the distribution and public communication of the information and content submitted through Ommnio, Ommnio being a communication medium.
The user who decides to share and provide content and/or information, such as images, opinions, and any other content, expressly consents that such content may be shared by all users of the tool for the purposes indicated in these Terms and Conditions and the purposes that the Clients determine for the Platform.
Likewise, Ommnio reserves the right to remove those communications, information, or content, as well as to block the offending user, that are considered inappropriate to the characteristics and purposes of the Platform.
Ommnio does not control the content, which is the responsibility of the users, and therefore cannot assume liability for the same.
Any user who violates current legislation shall assume exclusive liability for the damages and consequences arising therefrom, releasing Ommnio from any liability.


4. User License
Ommnio grants its users a non-exclusive and non-transferable license (hereinafter, the License) to use Ommnio.


4.1. Copyright
Ommnio is the owner of the Ommnio communication platform. This contract is a license to use the communication Platform and does not imply a transfer of ownership of the rights to said program.
The user may not change, destructure, disassemble, or decompile Ommnio, which includes the use of any current or future technology.
Breach of any of the terms and conditions of this License shall be construed as a breach of the Terms of Use.


4.2. Warranties and Liabilities
You must use the Platform in accordance with the terms and conditions of this document and the notices and communications that Ommnio provides.
Ommnio does not guarantee the availability, continuity, or fault-free operation of the Platform. Therefore, to the extent permitted by law, this warranty does not cover damages arising from the lack of availability or operation of the Platform and any services that Ommnio provides.
Ommnio does not assume liability arising from unforeseeable circumstances or force majeure. Likewise, it shall not be liable for any cause beyond reasonable control, such as the existence or introduction of viruses and third-party interference.


4.3. Duration of License
The term of this License begins with its acceptance by the User. Ommnio shall have the right to restrict, suspend, or terminate this License at its own discretion, whether in whole or in part, at any time and for any reason, without prior notice or liability.


5. Exclusion of Warranties and Liability
Ommnio reserves the right to cancel access to any service or to the Platform itself, as well as to all or part of the content provided through it, at any time and without prior notice, for technical, security, maintenance, or power failure reasons, or any other reasonable cause.
Consequently, Ommnio does not guarantee the reliability, availability, or continuity of the Platform or the content, and therefore the use thereof by users is at their own risk and Ommnio cannot be held liable for the discontinuity or unavailability of said services.
Ommnio is not liable for any interruption, delays, errors, malfunctions and, in general, any other problem arising from causes beyond the reasonable control of the Platform, and/or due to intentional conduct or fault of the users, and/or due to force majeure. Force Majeure is understood to mean all events that are beyond the reasonable control of Ommnio, such as: failures of third parties, operators, or service companies, acts of government, lack of access to third-party networks, acts or omissions of public authorities, or those resulting from natural disasters, power outages, hacker attacks or other third-party attacks on the security or integrity of the system. In any case, whatever the cause, Ommnio shall have no liability whatsoever for direct or indirect damages or losses incurred.
Ommnio disclaims any liability for damages of any kind that may result from the lack of truthfulness, accuracy, completeness, and/or timeliness of the content transmitted, stored, made available, or received, obtained, or accessed through the Platform, or for content provided by third parties.
Ommnio will make reasonable commercial efforts to update and correct the information hosted on the Platform that does not meet minimum standards of accuracy.
Ommnio is not responsible for the content of the information collected by Clients and users on the Platform, nor for the opinions, comments, or other communications that are not issued directly by Ommnio.
Ommnio excludes all liability for damages of any kind that may result from the presence of viruses or other harmful elements in the content that may cause alterations in computer systems, as well as in documents or other systems stored on the Platform.
Ommnio excludes all liability for the content that users publish on the Platform; therefore, users are responsible for the content sent by them.
Likewise, Ommnio is not responsible for the use that users make of their passwords, user menus, and any other material/service offered by the Platform.
Furthermore, Ommnio is not responsible for any security errors that may occur through the use of outdated versions of browsers or software, or for the consequences that may arise from browser malfunctions, whether due to incorrect configuration, computer viruses, or any other cause not directly related to Ommnio.
Notwithstanding the foregoing, with respect to the OmmnioSign service, Ommnio’s liability shall be governed by the provisions of the Service Practice Statement and the provisions of Regulation (EU) No 910/2014. Ommnio shall be liable for damages caused intentionally or through negligence to any natural or legal person as a consequence of non-compliance with the obligations arising from said Regulation in the provision of the electronic signature service. The general liability exclusions contained in this section shall not apply to the extent that they are incompatible with Ommnio’s legal obligations as a trust service provider.


6. Applicable Law and Jurisdiction
By accessing and/or using Ommnio, the user expressly agrees that all disputes, claims, and other matters arising from or related thereto shall be governed by current Spanish law and any dispute shall be submitted to the Courts and Tribunals of the city of Barcelona, unless consumer and user protection regulations establish a different criterion.
